By clicking “sign in,” “create account,” or “complete purchase” and entering or otherwise using our website or mobile application (the “Site”), you agree to and accept these terms and conditions. Certain products and services on our Site may have additional terms that apply (for example, if you enroll in our Treats loyalty program or you subscribe to our Auto ship subscription program, you also will be subject to the Treats rules and the Auto ship terms). If these Terms of Use are inconsistent with terms applicable to a certain product or service, those other terms will control.
THESE TERMS AND CONDITIONS, AS WELL AS ANY OTHER PRODUCT AND SERVICE SPECIFIC TERMS ON OUR SITE, CONSTITUTE YOUR SERVICE AGREEMENT (“AGREEMENT”) WITH PETSPLANET, INC. AND ANY OF ITS OWNED OR OPERATED SITES WHERE THESE TERMS OF USE ARE POSTED (“PetsPlanet”). THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS FOR YOUR USE OF OUR SITE AND YOUR PURCHASE OR USE OF ANY PRODUCTS OR SERVICES OFFERED ON THE SITE. BY ACCESSING AND/OR USING THE SITE, YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THE AGREEMENT AND TO ABIDE BY ALL OF THE TERMS AND CONDITIONS SET FORTH HEREIN. YOU MAY NOT ACCESS OR USE THIS SITE OR ACCEPT THIS AGREEMENT UNLESS YOU ARE AT LEAST 18 YEARS OLD. ARBITRATION NOTICE: THESE TERMS CONTAIN AN ARBITRATION AGREEMENT A LITTLE LATER ON THAT AFFECTS YOUR RIGHTS. YOU AND PETSPLANET AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING INDIVIDUAL ARBITRATION, AND YOU AND PETSPLANET WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AND THE RIGHT TO A JURY TRIAL. IN ARBITRATION, THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. PLEASE REVIEW THESE TERMS CAREFULLY.
Electronic Communications
When you use our Site or send emails and other messages from your computer or mobile device to us, you are communicating with us electronically. By doing this, you agree to receive our replies electronically in the same way and you can keep copies for your records. You agree that all agreements, notices, disclosures, and other messages we send you electronically count as being in writing.
Accounts
To use certain features of the Site, like buying products and services (“Products”), you need to create an account with PetsPlanet (“PetsPlanet Account”) and provide some information as prompted by the registration form. You promise that: (a) all the registration information you provide is true and accurate; (b) you will keep this information up to date; and (c) your use of the Site follows all applicable laws and this Agreement. You are responsible for keeping your PetsPlanet Account login details confidential.
You are fully responsible for all activities related to your PetsPlanet Account, including purchases, site use, and messages sent from your account. You agree to notify PetsPlanet immediately if you suspect any unauthorized use of your PetsPlanet Account or any other security breach. PetsPlanet will then secure your account to prevent further unauthorized activity.
Permissible Uses of Site
Subject to this Agreement, PetsPlanet gives you a limited, non-transferable, non-exclusive license to use the Site for personal purposes. This license does not include selling or using the Site for commercial purposes, or any other restricted activities listed below. PetsPlanet can end this license at any time for any reason.
Your rights to use the Site come with these restrictions: (a) You cannot use the Site to place orders for resale to others; (b) You cannot sell, rent, lease, transfer, distribute, or commercially exploit the Site, its products, or content without written permission from PetsPlanet; (c) You cannot modify, create derivative works from, disassemble, or reverse engineer any part of the Site; (d) You cannot use the Site to create a similar or competing service, or to download, copy, or collect content or account information for another business; (e) Except as stated here, you cannot copy, reproduce, distribute, republish, download, display, post, or transmit any part of the Site without written consent from PetsPlanet; (f) You cannot frame or use framing techniques to enclose any trademark, logo, or other proprietary information or content from the Site without written consent from PetsPlanet.
PetsPlanet reserves the right to change, suspend, or stop the Site or any part of it at any time, with or without notice. You agree that PetsPlanet is not responsible to you or any third party for any changes, suspensions, or discontinuation of the Site or any part of it.
